Welcome to Vika. By accessing or using the Vika platform at vikasocial.com("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the Service.

1. The Service

Vika is an AI-powered marketing platform that helps businesses create social media content for Instagram, TikTok, X (Twitter), and LinkedIn. The Service includes Brand DNA setup, AI content generation, and a content management interface.

2. Eligibility

You must be at least 16 years old and capable of forming a binding contract to use the Service. By using Vika, you represent and warrant that you meet these requirements and that all information you provide is accurate.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring that any brand information, logos, or content you upload does not infringe third-party intellectual property rights
• Notifying us immediately at tryvikaapp@gmail.com if you suspect unauthorised access

4. Acceptable Use

You agree not to use the Service to:

• Generate or distribute spam, misleading information, or illegal content
• Impersonate any person or entity
• Violate any applicable local, national, or international law or regulation
• Attempt to reverse-engineer, scrape, or extract the AI models or underlying infrastructure of the Service
• Use the platform to create content that promotes hate, harassment, or violence

5. AI-Generated Content

The Service uses large language models and other AI technologies to generate content suggestions. You acknowledge that:

• AI-generated content is provided "as-is" and may contain inaccuracies, errors, or omissions
• You are solely responsible for reviewing, editing, and approving any content before publishing it on social media platforms
• Vika does not guarantee that generated content is free from copyright concerns; you should independently verify before use
• Outputs are not a substitute for professional legal, financial, or marketing advice

6. Intellectual Property

You retain ownership of all brand data, logos, and original content you provide to the Service. By using Vika, you grant us a limited, non-exclusive licence to process your inputs solely for the purpose of providing the Service.

All Vika software, trademarks, logos, and product names are the exclusive property of Vika and may not be used without our express written permission.

7. Subscriptions & Billing

Vika may offer free and paid subscription tiers. Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice to existing subscribers.

8. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may cancel your account at any time from your account settings. Upon termination, your right to access the Service ceases immediately.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Vika does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Vika and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages. Our total liability for any claim under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of Istanbul, Turkey.

12. Changes to These Terms

We may revise these Terms at any time. We will notify you of material changes by email or by displaying a prominent notice in the Service. Continued use of the Service after the effective date of the updated Terms constitutes your acceptance.
